Terms of Use

1. The service

Exhibited.ai is an AI-powered photo critique platform currently operating as a closed beta. Access is by invitation only. We reserve the right to limit, suspend, or terminate access at any time, including during the beta period.

The service is provided “as is” and may change, be unavailable, or contain errors. We make no guarantees about uptime, accuracy of AI output, or the continued availability of any feature.

2. AI-generated critiques

Critiques, scores, mentor feedback, and podcast episodes are generated automatically by large language models (currently Claude by Anthropic). They reflect patterns in training data, not the considered opinion of a human expert.

AI outputs can be wrong, inconsistent, or reflect biases present in their training. You should use the feedback as one input among many, not as a final judgement on your work or your worth as a photographer.

We do not guarantee that critiques will be accurate, complete, or appropriate for any particular purpose, including competition entry, professional portfolio review, or print preparation.

3. Your content

You retain all rights to photographs you upload. You grant Exhibited.ai a limited, non-exclusive licence to store, display, and process your images solely for the purpose of providing the critique service to you.

By uploading a photograph you confirm that:

• You own the image or have the right to use and upload it.
• The image does not infringe on the copyright, privacy, or other rights of any third party.
• The image does not contain illegal content, including but not limited to child sexual abuse material.
• You have the consent of any identifiable people depicted in the image where required by applicable law.

4. Acceptable use

You may not use Exhibited.ai to:

• Upload content that is unlawful, harmful, or violates the rights of others.
• Attempt to circumvent rate limits, access controls, or security measures.
• Scrape, reverse-engineer, or systematically extract content from the service.
• Use the service in a way that disrupts or damages it for others.
• Misrepresent AI-generated critiques as human professional advice to third parties without appropriate disclosure.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Usage limits

During the beta, access is subject to monthly session limits set by the administrator. These limits may be adjusted at any time. Limits exist to manage costs and ensure fair access for all invited participants.

6. Third-party services

Exhibited.ai uses Anthropic (Claude) for AI analysis and ElevenLabs for audio synthesis. Your use of Exhibited.ai means your content is processed by these services on our behalf. Their own terms and acceptable use policies also apply. See our Privacy Policy for details.

7. Limitation of liability

To the fullest extent permitted by applicable law, Exhibited.ai and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to: decisions made based on AI critiques, loss of uploaded images due to technical failure, or service unavailability.

Our total liability to you for any claim arising out of or relating to these terms or the service is limited to the amount you have paid us in the twelve months preceding the claim (or €50 if you have paid nothing, as this is a free beta).

8. Changes to these terms

We may update these terms. If we make material changes, we will notify you by email with at least 14 days’ notice before the new terms take effect. Continued use after that date constitutes acceptance.
